Gleanr Terms of Service
Welcome and thank you for gleaning! By accessing the benefits of the gleanr.com service ("Gleanr"), you agree to be bound by the following terms and conditions ("Terms of Service").
Parties
This License Agreement is between CrowdTrust Technologies Inc. ("CrowdTrust") and any person who uses Gleanr information and services (our "Client").
Acceptance of Agreement
CrowdTrust Clients acknowledge acceptance of this Agreement by (i) clicking on the button indicating that the Agreement has been accepted and by (ii) providing a valid e-mail address.
Product Description
CrowdTrust's gleanr.com application ("Gleanr") provides Clients access to personalized information tools and services (collectively, the Client “Account”) which enable Clients to capture, store, organize and share digital information that they compose or encounter on the Internet, enhanced by further information that CrowdTrust may create or collect to make the original information more useful and valuable to the Clients (collectively an information package is a “Glean”). The purpose is to enable Clients to leverage and channel their Gleans to generate value for themselves and their networks (Client "Networks").
Core Service Principles
CrowdTrust Clients entrust their Gleans on Gleanr based on three core service principles:

Clients own their Gleans. Every Glean consists of the information stored along with any information CrowdTrust creates or collects to make it more useful. CrowdTrust will make no use of any part of any Glean without Client consent. When a Glean is deleted, or an Account closed, any information that has not been explicitly shared by the Client will be destroyed forever.

Clients control their Gleans. CrowdTrust Clients have complete control over creating and deleting Gleans, and sharing them with their Networks. For example, a Client may keep some Gleans totally private, and may share, collect, publish, and syndicate other Gleans with individual Networks as they wish, including what profile, contact, and personal information each Network can view about them.

Clients deserve value. CrowdTrust will keep Client Gleans secure and available, and will respect Client privacy strictly as they define it. CrowdTrust will strive constantly to make Client Gleans work effectively in all the ways that generate value for them.
CrowdTrust will not attempt to own or exploit Client Gleans or Networks in any way.
CrowdTrust’s success depends on maximizing the value of Client Gleans to them.
Core Usage Principles
CrowdTrust Clients access Gleanr services according to three core usage principles:

Clients will do nothing illegal. Application of CrowdTrust services for inappropriate or illegal purposes is strictly prohibited. CrowdTrust will actively support justice authorities in this regard.

Clients will respect information. CrowdTrust Clients will respect the privacy and copyright provisions of other Client information and of information producers in general. Clients will not misrepresent themselves or deliberately generate misinformation.

Clients will respect the crowd. CrowdTrust Clients will not act in any way that prevents others from using these services and generating value for themselves.
Deletion of Accounts and Gleans
CrowdTrust reserves the right to delete any Client Accounts and Gleans in relation to a violation of the Core Usage Principles, at the sole discretion of CrowdTrust.
Appropriate Information
Information submitted to Gleanr should not be discriminatory or prejudicial. Specifically, information that is discriminatory in terms of racial, religious, gender, sexual orientation, geographical region or other such grouping is not suitable.
Content on Gleanr
CrowdTrust does not regularly monitor the Gleans generated by its Clients. As such, some information located on Gleanr may be objectionable, inappropriate, or offensive to other Clients. CrowdTrust cannot guarantee that a Client of CrowdTrust will not locate unintended or inappropriate content and assumes no responsibility for this content. Client Gleans found in CrowdTrust do not in any way imply endorsement by CrowdTrust or any of its affiliates. Since this information is not under CrowdTrust's control, it cannot be held responsible for the contents or for the opinions and statements that may be expressed therein. CrowdTrust cannot guarantee the accuracy, reliability, or timeliness of information encountered on Gleanr and, therefore, CrowdTrust cannot be held liable in any capacity for damages or losses to a Client or any third party that may result from the use of this information.
Personal Use Only
Gleanr is made available for your personal, non-commercial use only. You may not use any of the services provided by Gleanr to sell a product or service, or to increase traffic to your Web site for commercial reasons, such as advertising sales. If you are interested in the commercial use of services provided by Gleanr, please enter into an agreement with CrowdTrust in advance. Contact us for more information.
Privacy
CrowdTrust may collect personal information, including e-mail addresses, when individuals register to use the CrowdTrust, Gleanr and associated services, post a link to the Gleanr or submit questions or comments. We may also, at times, collect our users' IP addresses and information regarding our users' use of our website and services. We may use such IP addresses to help diagnose problems with our servers, track movement within our website and, if necessary, deny service in accordance with these Terms of Service. We may also collect information related to the referring URL, access times and browser type.
Information that you provide to CrowdTrust is used for communicating with you and/or enhancing your experience with Gleanr. CrowdTrust does not distribute your personal information to others except as may be compelled by law. Aggregate, purely anonymous information may be shared with others to enhance our services.
To offer and provide optimized and personalized services, we use cookies to store and sometimes track information about our users. A cookie is a small amount of data that is sent to a user's browser from a web server and is eventually stored on a user's computer hard drive.

Changes in Terms and Conditions and CrowdTrust Services
We may modify or terminate our services from time to time, for any reason, and without notice, including the right to terminate with or without notice, without liability to you, any other user or any third party. We reserve the right to modify these Terms of Service from time to time without notice. Please review these Terms of Service from time to time so that you will be apprised of any changes.
Disclaimer of Warranties
CrowdTrust disclaims any and all responsibility or liability for the accuracy, content, completeness, legality, reliability, or operability or availability of information or material displayed in Gleanr and affiliated services. CrowdTrust disclaims any responsibility for the deletion, failure to store, misdelivery, or untimely delivery of any information or material. CrowdTrust is not obligated to retain or store any information or material submitted to Gleanr. CrowdTrust disclaims any responsibility for any harm resulting from downloading or accessing any information or material on the Internet through Gleanr or its affiliated sites. THE CROWDTRUST, Gleanr, ITS AFFILIATED SERVICES, AND ALL MATERIALS, INFORMATION, PRODUCTS AND SERVICES INCLUDED IN THE CROWDTRUST SERVICES ARE PROVIDED "AS IS," WITH NO WARRANTIES WHATSOEVER. CROWDTRUST AND ITS LICENSORS EXPRESSLY DISCLAIM TO THE FULLEST EXTENT PERMITTED BY LAW ALL EXPRESS, IMPLIED, AND STATUTORY WARRANTIES, INCLUDING, WITHOUT LIMITATION, THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT OF PROPRIETARY RIGHTS. CROWDTRUST AND ITS LICENSORS DISCLAIM ANY WARRANTIES REGARDING THE SECURITY, RELIABILITY, TIMELINESS, AND PERFORMANCE OF THE CROWDTRUST SERVICES. CROWDTRUST AND ITS LICENSORS DISCLAIM, ANY WARRANTIES FOR ANY INFORMATION OR ADVICE OBTAINED THROUGH THE CROWDTRUST SERVICES. CROWDTRUST AND ITS LICENSORS DISCLAIM ANY WARRANTIES FOR SERVICES OR GOODS RECEIVED THROUGH OR FEATURED ON Gleanr OR RECEIVED THROUGH ANY LINKS PROVIDED BY Gleanr , AS WELL AS FOR ANY INFORMATION OR ADVICE RECEIVED THROUGH ANY LINKS PROVIDED BY Gleanr. YOU UNDERSTAND AND AGREE THAT YOU DOWNLOAD OR OTHERWISE OBTAIN MATERIAL OR DATA THROUGH THE USE OF THE CROWDTRUST SERVICES AT YOUR OWN DISCRETION AND RISK AND THAT YOU WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGES TO YOUR COMPUTER SYSTEM OR LOSS OF DATA THAT RESULTS FROM THE DOWNLOAD OF SUCH MATERIAL OR DATA.
Limitation of Liability
UNDER NO CIRCUMSTANCES SHALL CROWDTRUST OR ITS LICENSORS BE LIABLE TO ANY USER ON ACCOUNT OF THAT USER'S USE OR MISUSE OF OR RELIANCE ON CROWDTRUST SERVICES. ARISING FROM ANY CLAIM RELATING TO THIS AGREEMENT OR THE SUBJECT MATTER HEREOF SUCH LIMITATION OF LIABILITY SHALL APPLY TO PREVENT RECOVERY OF DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, AND PUNITIVE DAMAGES WHETHER SUCH CLAIM IS BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR OTHERWISE, (EVEN IF CROWDTRUST OR ITS LICENSORS HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES). SUCH LIMITATION OF LIABILITY SHALL APPLY WHETHER THE DAMAGES ARISE FROM USE OR MISUSE OF AND RELIANCE ON CROWDTRUST SERVICES, FROM INABILITY TO USE CROWDTRUST SERVICES, OR FROM THE INTERRUPTION, SUSPENSION, OR TERMINATION OF CROWDTRUST SERVICES (INCLUDING SUCH DAMAGES INCURRED BY THIRD PARTIES). THIS LIMITATION SHALL ALSO APPLY WITH RESPECT TO DAMAGES INCURRED BY REASON OF OTHER SERVICES OR GOODS RECEIVED THROUGH OR FEATURED ON Gleanr OR RECEIVED THROUGH ANY LINKS PROVIDED, AS WELL AS BY REASON OF ANY INFORMATION OR ADVICE RECEIVED THROUGH OR FEATURED ON Gleanr OR RECEIVED THROUGH ANY LINKS PROVIDED IN CROWDTRUST SERVICES. THIS LIMITATION SHALL ALSO APPLY, WITHOUT LIMITATION, TO THE COSTS OF PROCUREMENT OF SUBSTITUTE GOODS OR SERVICES, LOST PROFITS, OR LOST DATA. SUCH LIMITATION SHALL FURTHER APPLY WITH RESPECT TO THE PERFORMANCE OR NON-PERFORMANCE OF CROWDTRUST SERVICES OR ANY INFORMATION OR MERCHANDISE THAT APPEARS ON, OR IS LINKED OR RELATED IN ANY WAY TO, CROWDTRUST. SUCH LIMITATION SHALL APPLY NOTWITHSTANDING ANY FAILURE OF ESSENTIAL PURPOSE OF ANY LIMITED REMEDY AND TO THE FULLEST EXTENT PERMITTED BY LAW. Without limiting the foregoing, under no circumstances shall CrowdTrust be held liable for any delay or failure in performance resulting directly or indirectly from acts of nature, forces, or causes beyond its reasonable control, including, without limitation, Internet failures, computer equipment failures, telecommunication equipment failures, other equipment failures, electrical power failures, strikes, labor disputes, riots, insurrections, civil disturbances, shortages of labor or materials, fires, floods, storms, explosions, acts of God, war, governmental actions, orders of domestic or foreign courts or tribunals, non-performance of third parties, or loss of or fluctuations in heat, light, or air conditioning.
Miscellaneous Provisions
These Terms of Service will be governed by and construed in accordance with the laws of the province of British Columbia, Canada without giving effect to its conflict with laws or provisions in your place of residence. If for any reason a court of competent jurisdiction finds any provision or portion of the Terms of Service to be unenforceable, the remainder of the Terms of Service will continue in full force and effect. These Terms of Service constitute the entire agreement between the parties with respect to the subject matter hereof and supersedes and replaces all prior or contemporaneous understandings or agreements, written or oral, regarding such subject matter.
